Request for Information: OSHA requests data, information and comment on issues related to the increasing use of ionizing radiation in the workplace and potential worker exposure to it. Specifically, OSHA requests data and information about the sources and uses of ionizing radiation in workplaces today, current employee exposure levels, and adverse health effects associated with ionizing radiation exposure. OSHA also requests data and information about practices and programs employers are using to control employee exposure, such as exposure assessment and monitoring methods, control methods, employee training, and medical surveillance.

Federal Agency: Federal Railroad Administration
Safety Advisory Notice: FRA is issuing a safety advisory to facilitate improved cooperation in the investigation of collisions at highway-rail grade crossings. The advisory describes the roles of the Federal and state governments and of the railroads in highway-rail grade crossing safety. FRA reminds railroads of their responsibility to: Properly report any accident involving grade crossing signal failure; properly maintain records relating to credible reports of grade crossing warning system malfunctions; properly preserve the data from all locomotivemounted recording devices following highway-rail grade crossing collisions; and cooperate fully with local law enforcement authorities during their investigations of such accidents. FRA also offers assistance to local authorities in the investigation of highway-rail grade crossing collisions where information or expertise within FRA’s control is required to complete the investigation.

Federal Agency: Federal Motor Carrier Safety Administration
Interim Final Rule: The Federal Motor Carrier Safety Regulations (FMCSRs) prohibit States from issuing, renewing, transferring or upgrading a ommercial driver’s license (CDL) with a hazardous materials endorsement unless the Transportation Security Administration (TSA) has first conducted a security threat assessment of the applicant and determined the applicant does not pose a security risk warranting denial of the hazardous materials endorsement. The FMCSRs currently provide a specific date on which States become subject to the new requirement. This interim final rule amends the FMCSRs to crossreference the TSA’s compliance date as the date when FMCSA’s companion requirements also become applicable. Consistent with TSA regulations, FMCSA also reduces the amount of advance notice that States must provide to drivers that a security threat assessment will be performed when they renew a hazardous materials endorsement. This rule is being issued as an IFR because it relates back to an existing substantive IFR published on May 5, 2003. This IFR will be subsumed into that rulemaking when it is finalized. All utstanding comments on these issues will be addressed in that final document.

Federal Agency: Nuclear Regulatory Commission
Solicitation of proposed changes: The U.S. Nuclear Regulatory Commission (NRC) and the U.S. Department of Transportation (DOT) are jointly seeking comments on proposed changes to the International Atomic Energy Agency (IAEA) Regulations for the Safe Transport of Radioactive Material (referred to as TS–R–1). The proposed changes were submitted by the U.S. and other IAEA member states and International Organizations, and might necessitate subsequent domesticcompatibility rulemakings by both the NRC and the DOT. Proposed changes will be accepted until July 1, 2005.

Final rule; announcement of effective date: On September 26, 2003, the Coast Guard published a final rule with one of the requirements being owners and operators of waterfront facilities who handle packaged and bulk-solid dangerous cargo must post warning signs constructed and installed according to the National Fire and Protection Association (NFPA) 307, chapter 7-8.7. An effective date was not published though for that section of the final rule. On January 29, 2004, the Coast Guard announced that requirement is effective March 1, 2004. Technical amendment: The Office of the Secretary of Transportation (OST) and the Transportation Security Administration (TSA) issued a technical amendment revising their regulations regarding the protection of sensitive security information (SSI). This rule removes an unintended limitation on parties that have a need to know SSI, specifically removing the limiting words "aviation or maritime" in 49 CFR Parts 15 and 1520. This will restore the original intent of this aspect of the SSI rule - to share vulnerability assessments and threat information with entities in all transportation modes that need the information to help forestall future terrorist attacks. Withdrawal of Proposal: The Research and Special Programs Administration the predecessor agency to the Pipeline and Hazardous Materials Safety Administration (PHMSA) and the Environmental Protection Agency (EPA) issued final rules in 1980 requiring that a manifest accompany each shipment of hazardous waste during transportation. In 49 CFR 172.205, PHMSA provided that the uniform manifest ‘‘may be used as the shipping paper required by’’ the Hazardous Materials Regulations, so long as it contained all the required information. On May 22, 2001, EPA published a notice of proposed rulemaking (NPRM) to revise the hazardous waste manifest system. One of EPA’s proposed changes would have allowed the uniform manifest to be prepared and transmitted electronically from the generator to the disposal facility, rather than requiring it to accompany the shipment. EPA is deferring final action on the electronic manifest pending further analysis, outreach, and possible supplemental proposals. Therefore, PHMSA is withdrawing an NPRM published on August 8, 2001, that would have amended the Hazardous Materials Regulations on the use of the Uniform Hazardous Waste Manifest for shipments of hazardous wastes. The changes proposed in that NPRM would have accommodated changes proposed by EPA. PHMSA proposed to require that, if the generator of a hazardous waste prepares an electronic manifest, either a physical copy of the electronic manifest or another document containing the information required for a shipping paper must accompany the hazardous waste in transportation.

Proposed Rule: RSPA issued a proposed rule regarding the transportation of compressed oxygen, other oxidizing gases and chemical oxygen generators by air. The agency proposes to require that oxygen cylinders and generator packages be placed in an outer packaging that meets certain flame penetration and thermal resistance requirements. This action is mostly in response to the May 11, 1996 crash of ValuJet Airlines flight No. 596, which had a fire in the airplane’s cargo compartment that was initiated and enhanced by one or more chemical oxygen generators that were being improperly carried as cargo.
